For EEA residents, Bitstamp Europe S.A. is a CSSF-authorized MiCA CASP. Outside the EEA, Bitstamp lists multiple legal entities and the serving entity depends on client residency, so EEA authorization is not generalized to every reader.

Regional eligibility and regulatory context

Bitstamp Europe S.A. is a Luxembourg crypto-asset service provider authorized by the CSSF under N00000003. Current 2026 MiCA whitepapers also identify it as a payment institution under Z00000012 and state that cross-border crypto-asset/payment services have been notified across EU/EEA member states.

Bitstamp's current API legal notice lists several legal entities depending on client residency, including Bitstamp Europe S.A., Bitstamp UK Ltd., Bitstamp Ltd., Bitstamp Global Ltd., Bitstamp Asia Pte Ltd. and Bitstamp USA, Inc. That is why this review treats residence and serving entity as a live onboarding check rather than projecting one license across the whole regional audience.

Trading fees: use the live account fee, not a documentation sample

Bitstamp publishes a fee-schedule page and authenticated API endpoints that return all trading fees or the fee for a specific market. The API documentation currently shows a BTCUSD response sample with 0.15000 maker / 0.16000 taker.

Fee evidence boundary

Those values appear inside API response samples. LemonBitcoin does not label them as a universal live retail tier. Before trading, check the current Bitstamp fee schedule or the authenticated fee endpoint for the relevant account and market, then include spread/slippage in the total-cost calculation.

Bitcoin withdrawals: supported, but the final fee is an account-level check

Bitstamp's API documents Bitcoin crypto withdrawals and returns a verification error for unverified users, confirming that KYC is required for the withdrawal path. The API also exposes withdrawal-fee endpoints and currently shows a 0.00015000 BTC Bitcoin-network response sample.

The sample is useful for understanding the endpoint, not as a guaranteed charge. Bitstamp's API also enforces a minimum withdrawal amount returned by the service. Check the live account/network value before sending. Lightning deposits or withdrawals were not verified in the first-party material checked for this publication.

Custody and reserve evidence

Bitstamp Europe S.A. is authorized under MiCA to provide custody and administration of crypto-assets on behalf of clients. Bitstamp has also stated that customer assets are segregated from corporate assets, held 1:1 with licensed custodians, and that most crypto is kept in cold storage. These are custody/security claims from Bitstamp; exchange balances remain custodial until withdrawn to a wallet you control.

PoR evidence boundary

Bitstamp published historical reserve/transparency material and says its financial controls are externally reviewed, but this source refresh did not verify a current user-verifiable exchange-wide PoR report. A company statement, annual audit process or educational PoR article is not relabeled as a current Merkle-tree reserve verification.

Security controls and material history

Bitstamp documents withdrawal-address whitelisting, multi-factor security practices, cold-storage custody and security certifications including SOC 2 Type 2 and ISO/IEC 27001 in company materials. These controls reduce specific operational/account risks but do not eliminate phishing, credential theft, custodial counterparty risk or user mistakes.

On 4 January 2015, Bitstamp disclosed that operational wallets were compromised, resulting in a loss of less than 19,000 BTC. It said the overwhelming majority of reserves were in offline cold storage and that customer balances before the suspension would be fully honored. The incident is old, but material history stays visible.
